The application of Eugene Volokh for leave to file parts of his amicus curiae brief under seal is denied. (See Cal. Rules of Court, rule 8.46(d).) Amicus curiae shall notify the clerk in writing within 10 days of this order whether he wishes to have the unredacted brief filed. (Cal. Rules of Court, rule 8.46(d)(7).) Absent such a statement, the clerk is directed not to file the unredacted brief that was lodged conditionally under seal with this court on April 20, 2017, and instead to return that brief to amicus curiae after 10 days have elapsed.
This court having previously filed amicus's redacted brief by order of May 1, 2017, if amicus curiae does not request the filing of his unredacted brief, amicus curiae may file and serve a revised brief that omits the redacted portions no later than May 20, 2017. Good cause is hereby found for such a filing.
Should amicus curiae file and serve a revised brief, or notify the court in writing that his unredacted brief is to be filed, the time period for filing answers to amicus curiae shall run from the date the revised brief or unredacted brief is timely filed; otherwise it shall run from the date of this order.
